This campaign is conducted by nv Cibo, having its registered office at Deugenietstraat 5, 3150 Tildonk, registered in the CBE under number BE0403.556.028 and accessible at [[email protected]] (hereinafter referred to as: “Cibo”). The campaign will be carried out in accordance with the conditions laid down in these campaign rules (hereinafter referred to as: the "Rules"). 

These Rules can be consulted during the Campaign Period on the website [https://cibogroep.ac-page.com/niet-tevreden-geld-terug-voorwaarden]. 

  

By participating in the Campaign, you unconditionally accept the contents of these Rules and, furthermore, you accept any decision made by Cibo in connection with the Campaign.

 

VALIDITY PERIOD

      

The Campaign is valid from [18 April 2022] to [1 September 2022] (hereinafter referred to as: "Campaign Period"). 

CAMPAIGN TERMS AND CONDITIONS

     

The Campaign only applies to companies based in Belgium that have placed an order during the Campaign Period and invoke the "Money Back Guarantee if not Satisfied" Campaign.  

  

The Campaign applies only to orders with a minimum quantity of 30 pieces (RCD discs) that are placed on the Cibo dealer website (hereinafter referred to as: "Order"). 

  

The following cannot participate in the campaign:

  

❎ Individuals; 

  

❎ Subsidiaries of Cibo or companies directly involved in the design, development, organisation, administration and/or promotion of the campaign; 

  

❎ Partner companies that are directly or indirectly involved in the design, development, organisation, administration and/or promotion of the campaign.

  

Each company is entitled to a voucher equal to the amount of its Order, with a maximum of the price equal to 30 times an RCD disc, if: 

  

⚙️ the company is dissatisfied with its Order; 

  

⚙️ and has a justifiable reason for such dissatisfaction; 

  

⚙️  or demonstrates an error in production leading to the dissatisfaction with its order; 

  

⚙️ after consultation with Cibo and analysis by a sanding expert, it is determined that Cibo cannot offer a solution to resolve the dissatisfaction; 

  

⚙️ the dissatisfaction occurs within the Campaign Period.

  

Each company may invoke this guarantee only once within the Campaign Period. 

      

Disqualification, suspension or cancellation.    

 Any violation of these Rules or any fraud will result in the disqualification of the company from the Campaign. Cibo may disqualify a company in case of clear and reasonably founded suspicions of violation of these Rules. 

  

In case of cheating, manipulation, abuse, deception or fraud, the company concerned will be excluded from the campaign.  

  

Companies excluded will be immediately and permanently excluded and will no longer be able to participate in the campaign, nor to any future campaigns of Cibo. In all such cases, Cibo's decisions will be final.

  

Cibo also reserves the right to shorten, suspend or extend the campaign or to change the terms, the amount of the voucher or any other modality thereof at any time and subject to its sole discretion, even beyond any situation of force majeure, without any of the companies that have participated in the campaign acquiring any right of recourse against Cibo on the grounds of the same. 

  

Where an amendment or suspension of these Rules occurs, Cibo will clearly communicate a notice of such amendment or suspension. 

  

Promotion of the Campaign.

 

The campaign will be announced through advertising materials of Cibo's participating dealers.     

Liability

Cibo, or the third parties engaged by Cibo, exclude any liability for any possible disadvantages or damages suffered by a participating company as a result of participating in the campaign. 

  

Cibo, or the third parties engaged by Cibo, exclude any liability for any printing, spelling, typesetting or other errors, technical interruptions, failures or defects or any other problems relating to the campaign, difficulties in accessing the websites or delays, except for damages attributable to - and resulting directly from - wilful misconduct or gross negligence on the part of Cibo. 

  

Cibo shall do everything possible to ensure that the campaign runs smoothly from a technical and administrative point of view. Should problems of any nature arise, the company participating in the campaign discharges Cibo from all responsibility and waives any form of compensation. 

  

If the campaign is terminated as a result of the conduct of one of the companies participating in the campaign, Cibo reserves the right to claim compensation for the damage suffered. 

  

Except in cases of gross or intentional negligence, neither Cibo, nor its personnel, nor any third party which it has called upon for the organisation of the operation shall be liable for any damage of any kind that may arise from participation in or the organisation of the campaign. The liability of the parties mentioned in this subclause may under no circumstances be increased following any modification, suspension or termination of the campaign as mentioned in the previous subclause.

  

If force majeure or any other circumstances beyond its control so require, Cibo reserves the right, without prior notice and without giving any reason, to modify, postpone, curtail or prematurely terminate the campaign or any part thereof as well as to modify, postpone, curtail or cancel the rules and information relating to the campaign (e.g. due to organisational, technical or legal reasons). Communication in this regard will take place by e-mail. Cibo cannot be held liable for the same. 

  

In any event, Cibo's liability shall always be limited to the amount of the value of the Order with a maximum of the value of 30 RCD discs

      

Personal data

When participating in the campaign, the company communicates personal data to Cibo. Cibo processes these personal data in compliance with the Belgian Law of 30 July 2018 on the protection of natural persons with regard to the processing of personal data and with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC ("GDPR").

  

The data of the company participating in the campaign will be processed by Cibo in order to perform the agreement requested by the company. Cibo may, with the prior consent of the company, use the company's data for direct marketing purposes, in case the appropriate box has been tick-marked/checked at the time of placing the order.   

  

In order to ensure the smooth running of the campaign, Cibo shall allow access to the personal data of companies by the representatives with whom Cibo cooperates as well as third parties, insofar as this is necessary in order to send the vouchers to the said companies and to notify them concerning the progress of the campaign. Cibo guarantees a similar level of protection by making enforceable contractual obligations that are similar to those stipulated in these Terms and Conditions. Furthermore, Cibo shall not sell, rent, distribute or otherwise make personal data commercially available to third parties, except as described in the present Clause 7 of the Rules or with the prior consent of the contact person within the company. 

  

Cibo is the data controller and, for the purpose of processing the personal data, relies on a third party, which shall act as processor. This party will process the personal data in this context only in accordance with Cibo's instructions. Cibo shall ensure that all processing of personal data complies with the applicable Belgian and European privacy legislation. The personal data may be transferred to external service providers of Cibo, who will be responsible for the follow-up of the campaign.

  

The personal data referred to include the name, e-mail address and telephone number of the contact person within the company and any other data that may be processed subsequently. These data are collected with the aim of ensuring the smooth running of the campaign, in particular the possibility of making contact with the contact person within the company with regard to the campaign.   

  

The contact person within the company authorises Cibo to contact the company via the data provided for direct marketing purposes in case the appropriate box has been checked at the time of placing the order.

  

The contact person within the company may at any time object to such use of his personal data and/or revoke this consent by sending an e-mail to [email protected]

  

The contact person within the company has the right to access, modify and rectify or delete his data. This right can be exercised by sending an e-mail to Cibo at [email protected] with a copy of the identity card attached. If the contact person within the company requests the complete or partial removal of his data before the end of the campaign, so that he can no longer be contacted by Cibo, the company may be excluded from the campaign.

The company guarantees that all personal data provided as part of the campaign are correct, up-to-date and complete    

Practical follow-up, conflicts and complaints

          

Any complaint in connection with this campaign must be sent in writing by registered letter to Cibo, at the latest within 5 working days following the end of this campaign.   

  

In case of disputes concerning the application or interpretation of the present Rules, the contact person within the company undertakes to first seek an amicable solution in consultation with Cibo before starting a legal procedure.

  

All decisions of Cibo within the framework of the campaign are final, irrevocable and binding. There is no right of appeal against these decisions.

  

Complaints submitted outside the deadline or otherwise than in writing will not be dealt with.

  

These rules and the course of the campaign itself are subject exclusively to Belgian law.

  

The courts and tribunals of the judicial district of Leuven shall have sole jurisdiction to hear any disputes regarding the application thereof and thus to take cognisance of any disputes relating to the establishment, validity, performance, observance and interpretation of these Rules with respect to companies. 

  

Should one of the provisions of these Rules be deemed null and void or invalid, the other provisions of these Rules shall remain in full force and effect.

  

Participation in the campaign implies full and unconditional acceptance by the company of these Rules. 

  No part of or relating to this campaign may be copied, reproduced or published without the prior express written consent of Cibo.
